Terms and conditions of Prince Prime Properties Ltd (the sourcer): These are the sourcer’s terms of business and all investors should satisfy themselves that they have read and fully understood the terms and conditions set out below before signing.Interpretation: buyer, client and investor are used interchangeably, and refer to the person purchasing the deal. Similarly, reference to a property deal is interchangeable with land where this agreement concerns land or a mixture of both land and property.Finder’s Fee: The Finder’s Fee is payable on instruction and in full. No exceptions.

Client’s ResponsibilitiesPrince Prime Properties Ltd highly recommends that you instruct an independent viewing of the property and satisfy yourself that there is sufficient demand in the area for the end purpose of the property.• It is the client’s responsibility to ensure they can obtain the finance to purchase the property.
• It is the client’s responsibility to ensure they are happy with the deal provided.
• It is the client’s responsibility to provide all the requested documentation within 24 hours of reserving the deal and paying the fee.
• Documentation must be provided and verified as true and factual by an approved professional.
• All fees must be paid by the investor purchasing the deal. No third-party payments are accepted. Sourcer will reject these if they occur.
• It is the client’s responsibility to ensure that it will satisfy all checks carried out by the sales and or lettings agent, failure to do so will forfeit all refunds.
• The agreed reservation fee is required before any sensitive information relating to the property deal is released. The full finder’s fee, as outlined in the deal summary (or £3,000, whichever is greater), must be paid in cleared funds before the introduction to the agent or landlord is made for finalisation of the agreement.
• All fees must be paid when due with cleared funds.
The client agrees not to disclose any business dealings, property details, or conversations between themselves and the sourcer on any forum including social media, the internet or other forums.
• The client has agreed to conduct all business through the sourcer concerning the disclosed properties. If the client makes any attempt to make communication directly with the vendor or estate agent without the sourcer’s express written permission they agree to compensate the sourcer to the sum of the full finder’s fee, as outlined in the deal summary (or £3,000, whichever is greater) for its work in finding, researching and securing the said properties. Similarly, this agreement shall be deemed fulfilled when a client makes an application on the property.
• The client agrees that it must go through Prince Prime Properties Ltd on any subsequent property or land deal (to which this agreement does not concern) where the subsequent deal involves the same: lettings agent; estate agent; vendor landlord or representative thereof. A fee shall be attached which shall be determined by the sourcer.
• Where the client wishes to sell or pass on the Deal, and it has completed on the Deal, it must engage the services of the sourcer.
• The client acknowledges that the achievable rental or resale income is an estimation only compared to other properties in the area. The income is not guaranteed and should not be treated as such.

The Sourcer’s Responsibilities• The sourcer has carried out sufficient due diligence on the property and area to satisfy itself that the deal is a viable option.
Refund requests must be made in writing following the refund procedures set out below.
• Administration costs of at least 10% may be deducted from any refund at the sourcer’s discretion.
• The sourcer will only refund the account from which the payment was made. The sourcer will require proof of this payment and cannot issue any refunds until we have received this. No exceptions.
• The sourcer will keep and store all personal information and documentation securely and in accordance with ICO data protection regulations.
• The sourcer will request various documentation from the investor as part of its client’s due diligence process. This is a legal requirement to comply with anti-money laundering regulations.
• The sourcer reserves the right to use a third-party approved company to assist with carrying out client due diligence.
• The sourcer reserves the right to refuse to serve any investor it suspects of acting in a fraudulent manner.
• The sourcer will provide the investor with full disclosure within 24 hours of the finders fee being paid.
• The sourcer is not liable for the success of any property income.
• The sourcer does not guarantee any rental income or achievable rent as a guaranteed rent.
• The sourcer does not guarantee any tenants or income from tenants.

Property DetailsThe sourcer will provide you with the following property details once the full fee has been paid.
• Full postal address
• Any additional pictures and video
• Any RICS surveyor report if available

Property ValuationsThe sourcer will always negotiate the best possible price when securing a deal. The sourcer highly recommends that you have a full property valuation and survey carried out.Down Valuations – On occasion, properties may get downvalued at the point of the survey. This happens for many reasons and cannot be prevented. If this occurs, please understand that this is generally a bricks-and-mortar valuation. If the property is an up-and-running HMO property, it is unlikely that the surveyor will allow additional margin for conversions, furniture and dressings.Note – A down valuation is not a valid reason for a refund and the investor must satisfy themselves that they are confident in the valuation and comfortable with their investment. See note below in replacement policies.On the rare occasion that a property is down-valued, the sourcer urges the investor to factor in the costs they would have to incur after completion in converting and furnishing the property. The sourcer is unable to refund the finder’s fee if the investor opts to withdraw from a sale due to a down valuation.

Conversions and RefurbishmentsThe sourcer is not responsible for any costs incurred in converting or refurbishing the property.We will always give an estimate only for conversions and refurbishments. This is an estimation only and should not be taken as a guarantee that no other work will be required.

Replacement PropertiesThe sourcer can opt to offer a replacement property in the following circumstances:
• If a vendor/homeowner withdraws from the sale or letting at any time during the purchasing or letting process.
• If the investor is declined a loan, the sourcer may offer a replacement property when they can obtain funding.
• If the investor fails referencing, after exhausting all possible means to satisfy referencing (the replacement property may be sourced once the investor is in a position to pass referencing).
If the sourcer provides a replacement property, it will do so within three months. The sourcer will offer you any of the properties it has that match your original purchase before the sourcer offers these to other investors.

Refund PolicyThe refund policy is as follows:You may request a refund by email to [email protected].Proof of payment will be needed and if your request is accepted the original account will be refunded within 28 days of the request.Any and all such requests shall be determined on a discretionary basis. Grounds should be evidenced in writing, legitimate and supported by material data.On receipt of a refund, the client acknowledges and agrees that he (and any persons acting as agent for the client or employee(s) of the client) will cease all contact with the estate agent / letting agent / vendor / homeowner connected to this deal for 7 year “prohibition period”, starting from receipt of the refund.Any attempt by the client (agent acting on behalf of the client or employee(s) of the client) to contact the aforementioned person(s) or company(s) within the prohibition period following a refund request, will incur a fee equal to the full sum of the finders fee, payable to the sourcer.The sourcer will not compensate or cover any costs incurred by the customer for legal fees incurred in any circumstance. Administration costs may be deducted from an agreed refund.Where the client (agent or representative thereof) submits an application, contract or paperwork to an agent, representative, landlord or vendor of the property in order to proceed on the property, this contract shall be deemed as duly fulfilled and completed.

LANDLORD & VENDOR FEESManagement ServicesStandard buy-to-let management taken on a case-by-case basis and charged at a fixed monthly fee, agreed individually with each client.Fixed RentLandlords receive a fixed monthly rent amount for the lease period. Payments are not affected by occupancy or voids.Terms are agreed upfront and set out clearly in the lease agreement.Property SalesNo fees are charged to vendors for the introduction to a buyer. A fully inclusive purchase price is agreed, generally excluding other third-party costs such as legal fees.

INVESTOR FEESLoan Agreement (Fixed Interest)Investor funds are provided as a loan to support rent-to-rent leases or property purchase projects.Funds are safeguarded through a regulated client money account, ensuring they are held separately from company operating funds. Where applicable, funds may also be transferred via a solicitor’s client account prior to completion of a deal.The loan capital is retained for a fixed term of at least 18 months from completion, and repaid in full at the end of the term together with the agreed interestAll terms, including repayment schedule and security (where applicable), are confirmed in a written loan agreement before funds are accepted.Sourcing Fees (Bespoke Sourced Deals)Sourcing fees are priced individually based on the property, investment criteria and anticipated returns.All sourcing fees are agreed in writing before progressing with any deal.Serviced Accommodation ManagementDelivered in partnership with a trusted operator.Options include:• Learn as you earn: ongoing management consulting• Full management: fully outsourced serviceAdditional NotesLegal fees, surveys, and other third-party costs are the investor’s responsibility and are not included in our sourcing fee.Please contact us for the most up-to-date fee schedule.
